Court Resolves Large Property Debt Dispute

The Dubai Court of Cassation has sided with a property buyer, dismissing a real estate developer's claim for over Dh20 million. The ruling concludes a lengthy legal battle concerning unpaid installments for residential units in Al Barsha South. The buyer had already paid over Dh23 million for multiple apartments in the project.

The developer's claim for an additional Dh20.5 million, plus compensation, was deemed unfounded after thorough expert reviews. The court found the buyer had met all financial obligations and criticized the developer for lacking credible evidence of any default. A court-appointed expert confirmed full payment and attributed any project delays to the developer.

The buyer's legal team argued the claim was an abuse of contractual rights, as their client had no outstanding dues. Legal consultant Dr. Hassan Elhais highlighted the court's commitment to evidence scrutiny, emphasizing that developers cannot pursue baseless claims against compliant buyers. The court dismissed the developer's claim entirely and awarded legal costs to the buyer.
