Property Dispute Resolution in Abu Dhabi

Abu Dhabi's real estate regulations have been updated to streamline dispute resolution and protect the rights of both developers and investors in the off-plan property market. A key change is the shift away from court proceedings for resolving off-plan property disputes. Instead, the Abu Dhabi Real Estate Centre (ADREC) will oversee these disputes, saving time and legal expenses for investors and developers.

The updated rules establish a clear process for developers seeking to terminate Sales and Purchase Agreements (SPAs) with non-compliant buyers. Crucially, developers cannot automatically terminate SPAs. ADREC will review each termination request to ensure developers adhere to proper regulatory procedures and project completion timelines. The buyer's rights are also safeguarded, with ADREC verifying notifications and preserving the buyer's right to seek court or arbitration if necessary.

In addition to dispute resolution, the new regulations tighten requirements for property advertisements and broker practices. Property agents must now obtain "Madhmoun" permits and receive authorization from property owners before advertising properties. This aims to eliminate duplicate, fake, and unauthorized listings, creating a more reliable experience for property seekers.

These changes reflect a broader trend in the UAE to have real estate departments oversee property-related disputes, leveraging sectoral expertise to expedite resolution. The reforms are designed to foster a more mature and professional real estate market, with potential future improvements including standardized broker contracts and fee agreements.
